Abstract

A huge number of pending cases has long been a challenge to the Indian criminal justice system. By early 2000s, the trial courts were overwhelmed with masses of pending cases, and the delays were often many decades long. Not only did the backlog destroy the confidence of the people in the judiciary but it also infringed the constitutional provision of a speedy trial in Article 21(Alschuler, 1968). In this regard, plea bargaining was presented as a useful innovation to resolve the structural inefficiencies and to offer a more expedient means of delivering justice.
